Judge orders regulating pool safety

In ruling on 18 February, the court 39 Administrative Bogota Circuit ordered the Ministry of Social Protection to immediately comply with Article 18 of Law 1209 of 2008, which sets standards of pool safety.

According to the court ruling, the Social Protection Ministry must, within ten days, forward the process of review and adjustment of the draft resolution to be of strict compliance with the Act 1209 of 2008.

"The process will culminate in a maximum period of two months from the date of commencement. As stated above, the Ministry of Social Protection, the maximum period of two months, shall regulate the security measures, "states the ruling.

The above means that the Ministry of Social Protection in a period of four months should give compliance with the law and that all pools of the country comply with safety standards.

Eduardo Enrique Tovar said that months ago he had requested an explanation but these were delayed without sufficient reason, which led to initiate enforcement action.

"They said they had issued two resolutions and two others were in the process of study and dispatch. In reviewing the content of these expeditions I realized that most of the issues they had to regulate not been met," said Tovar. Finally

said the government failed as enshrined in Article 11 on the minimum safety standards and article 18 that the deadline for the Regulation of Law 1209.
